Federal Judge Orders Release of Kilmar Abrego Garcia from ICE Custody
A court has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his continued detainment is without lawful basis.
"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her ruling.
The case originates in a mistaken deportation to El Salvador earlier this year, which the government later admitted was an mistake. After his repatriation to the United States to answer human smuggling allegations, he was held in immigration custody.
In her decision, the judge pointed out that the government does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this time."
